General Terms & Conditions of Use of Scrapeworks Data.

Definitions and interpretations

Throughout these terms and conditions, the following words will have the following meaning set against them:

“Agent” - individual or company instructed to act on behalf of the Client as an agent;

“Client” any individual or company purchasing Advertising from Scrapeworks;

“Content” any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website;

“Customer Data” means any data, information or material provided or submitted by you to Scrapeworks agreeing to utilize our product and services;

“Effective Date” means the earlier of either the date you begin using our Scrapeworks Services or the date you agree to this Agreement by selecting “I Agree”;

“GDPR” General Data Protection Regulation, EU law on data protection and privacy for all individuals within the European Union and the European Economic Area, which came into force on 25 May 2018;

“Member(s)” Users who have an active subscription to a Scrapeworks Product;

“Membership Product(s)” Services and Content offered to Members in a subscription package upon registering as a Member depending on the specific Membership tier that they have purchased;

“Membership” a Members subscription package to a Scrapeworks Product;

“Partner” third parties (who may or may not be Members or Users) who have licensed Third Party Content to Scrapeworks in the form of Partner Downloads;

“Partner Download(s)” Third Party Content in the form of a Report created by Partners and which has been uploaded to the Website and available to Users on terms as specified on the relevant part of the Website;

“Privacy Policy” Scrapewoks current Privacy Policy as the same may be amended from time to time and currently viewable here: https://www.scrape.works/privacy-policy

“Products” physical copies of content in print form or otherwise including print copies of Books, ebooks, whitepapers, infographics, and other resources;

“Resources” individual articles and reports available for download or viewing via our website which may be subject to the payment of a one-off fee, or available only as part of a Membership subscription;

“Services” collectively or individually as appropriate, any product or service provided by Scrapeworks including but not limited to any services listed on the Website, Products, Resources, and Events;

“Subscriber” the individual or company that has demanded an annual subscription product;

“User”, “Users”, “you” Any and all persons who access the Site and services provided by Scrapeworks, including but not limited to Members;

“Website” the website owned by Scrapeworks with the URL: https://www.scrape.works/ and any sub-domains of this site, unless expressly excluded by their own terms and conditions.

License Grant

Adhering to the terms and conditions, Scrapeworks grants you a limited and non-transferable, non-negotiable, universal license to use our Services solely for your internal business use.

Subjected to the terms and conditions, the client shall:

• Use the data for personal purposes. Use the data internally within your company.
• Use licensed data to integrate, publish, modify, merge, compile with first- or third- party data, enhance & distribute as part of licensee's products.
• Publish statistics or visuals using the data. Attribution to Scrapeworks data is mandatory.

License Restrictions

Adhering to the terms and conditions, the client is subjected to the following conditions and shall not:

• Resell, republish, sublicense, or give away the licensed data to a third party in its original or in its raw format
• Allow users of an application or service that uses purchased Scrapeworks data to download or export large or complete portions of the data
• Access, copy, and modify any computer coding used by our Scrapeworks to build a similar or competitive product or service utilizing Scrapeworks features, functions, and ideology.
• Scrapeworks reserves the right to pursue legal remedies against a customer who violates these terms and conditions.

Payments & Invoice

Adhering to the terms and conditions, you agree to pay all applicable charges including applicable taxes or any charges imposed by the government. There are no refunds and Scrapeworks has the sole authority to change the pricing at any time. If you have any queries or disagreement in any of the charges, you must send it in writing within 2 weeks of your original deduction. Failure to do so may result in a waiver of your refund.

Availability of the Website and Disclaimers

The Services are provided "as is" and on an "as available" basis. Scrapeworks gives no warranty that our services will be free of defects and/or faults. To the maximum extent permitted by the law, no warranties (expressed or implied) of fitness for a particular purpose, the accuracy of the information, compatibility and satisfactory quality. Scrapeworks is under no obligation to update information on the Website.

While Scrapeworks uses reasonable measures to ensure that our product and services are secure and free of errors, viruses, and other malware, Scrapeworks gives no warranty or guarantee in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

You are responsible for all Content you provide, in any manner, via our product/ service/ website, and you represent and warrant you have all rights necessary to do so, in the manner in which you provide it. You are responsible for all your activities in connection with the product. Scrapeworks takes no responsibility for any disruption or non-availability of our website or services.

Scrapeworks reserves the right to alter, suspend or discontinue any part (or the whole of) the service including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the service unless it is expressly stated otherwise.

Scrapeworks has the sole right to change these conditions at any time and your affiliation with our services will be based on those terms at the time of your use.
